依照職業災害勞工保護法第7條：

勞工因職業災害所致之損害，雇主應負賠償責任。但雇主能證明無過失者
，不在此限。

如果是駕駛自己飲酒所造成的話，雇主當然沒有過失，不必賠。因為酒是駕駛自己要喝的，不是老闆要他喝的。

如果是老闆明知駕駛有飲酒仍然要他開車，那老闆就有賠償責任。

或者是老闆要駕駛喝酒後開車，那老闆也有賠償責任。
